Family sponsored immigrants

This type of green card is for families and marriages. It is split up into two separate sections: immediate relatives and preference immigrants.

Immediate Relatives

Who qualifies:

Spouses, parents, and children under 21, and some widows and widowers of U.S. Citizens. There is no limit on the number of immediate relatives that are eligible to immigrate each year.

Documents you will need:

  • Proof of relationship [marriage certificate, etc.]


  • Birth Certificate


  • All immigration documents [passport, I-94 card, IAP-66 forms, I-20, etc.]


  • Proof of sponsorship


  • Steps (If in U.S.):

    1. Filing of Alien Relative Petition (I-130) with Application to Adjust Status to Permanent Resident (I-485) with the U.S. CIS National Benefits Center

    2. Appointment for taking of Fingerprints at U.S. CIS Application Support Center

    3. Appointment for interview at local U.S. CIS District Office (3-15 months after filing)

    4. Decision of U.S CIS Officer

    Preference Immigrants

    Note: per-country and worldwide quotas apply to all categories and can result in long delays.

    Who qualifies:

    1. Unmarried sons and daughters, 21 or older, of U.S. Citizens

    2.a. Spouses and unmarried children under 21 of Permanent Residents
    2.b. Unmarried children, 21 or older, of Permanent Residents

    3. Married children of U.S. Citizens

    4. Brothers and sisters of U.S. Citizens who are 21 or older

    Documents you will need:

  • Proof of relationship [marriage certificate, etc.]


  • Birth Certificate


  • All immigration documents [passport, I-94 card, IAP-66 forms, I-20, etc.]


  • Proof of sponsorship


  • Steps:

    1. Filing of Alien Relative Petition (I-130) with U.S. CIS Service Center having jurisdiction over state of residence.

    2. When priority date becomes current: Filing of Application to Adjust Status to Permanent Resident (I-485) with the U.S. CIS Service Center having jurisdiction over the applicant's place of residence

    3. Decision of U.S. CIS
